Retail case Retail case

I purchased a laptop from a local store in Chennai on May month. The shop owner promised it was a demo laptop which was kept in HP showroom for demo and it carries 1 year HP warranty and 6 months retail store warranty, he also said it comes with original HP laptop bag. The deal was finalized for 25500 rs and I tried to make the payment via card and convert it into emi. He came up with a suggestion that " Sir we can use Shopsy app for it so that your EMI will be low, I said Okay. From Shopsy side they said the loan will be approved for Rs.50000 only. The shop owner said sir we will apply for this, the amount will be debited to me within 10 days, once the amount was debited I will send the balance amount to you. I trusted the shop owner and said Okay for this and bought the laptop. Later I came to know that the laptop he gave was not an demo piece, it was used by someone and repaired by him, the bag he gave was not original HP laptop it was fake one. I felt cheated but I didn't asked about this with him, I focused only the refund it's been more than 40 days, whenever I call him, he replies Sir it was an issue from Shopsy side I'm contacting them frequently you will get your money soon. I'm calling him daily and he is saying this repeatedly. I don't know what to do now. I have the call records and video proof with me. Can you please suggest me a better and proper solution for this?

A.Dear client,
Please send the shop owner a legal notice through an advocate. If that does not work out, please file a complaint under section 420 of IPC(Cheating) against him. Alternatively, you can also file a complaint in the district consumer redressal forum under the Consumer protection act to recover money/claim damages
