I have joined one company on 12th June 2023, after that I have received another offer from MNC and they have provided offer based on the Current offer letter. I have given resignation in Current organization, since I haven't received any project access manager is ready to release and HR is also ready to release me early but they are not ready to provide Experience / Reliving letter. They are saying if you work for 90 days we will provide all the documents and I am ready to work but still they are saying like we can't keep you by giving salary. Could you please help how to proceed legally in this case.

A.Hi client,

In that case, contact an advocate for reviewing your employment contract. If they are doing unjustified things then send a legal notice to the employer.

Ideally you can approach a lawyer and ask them to help you draft a legal notice after reading through the terms and conditions of your employment contract with your current organization

In case the contract of employment stipulates the condition of 90 days of work in the Company to get the desired documents or monetary benefits available to an employee who tendered resignation, then both employer and employee are duty bound to abide by or comply with the said condition of the contract of employment. On breach of said condition on the part of the employer/Company that amounted to unfair labor practice, they will be liable to face legal consequences for such arbitrary and unjustified action. In the prevailing situation, you need to serve a legal notice to the employer and reach out to the office of the concerned Labour commissioner to file a complaint against the employer for victimization and unfair labour practices to resolve your grievance.
