Can the redevolopment committee of a society , going for redevelopment, have an active member against whom an FIR has been filed regarding financial fraud at another society which had employed him ?
A.Dear Client,
A Society registered under the respective State Cooperative Society Act and governed by the Byelaws of the Society. If the Byelaws of the Society say that a member having a criminal record shall be ceased from holding any position in the Governing Body or Executive Committee, then the said member cannot be a member of the Redevelopment Committee.
