Not returning of service fees Not returning of service fees

I have paid INR 12340/- on 24.04.2023 for a consultancy service to M/s CV Designer (A Days group of company) for delivery of "Visual CV + Text CV + Pure Text CV (Global ATS Format) + Cover Letter + LinkedIn Makeover ". They were supposed to deliver the same within 10 days but due to their internal challenges they have failed to meet the commitment. I have patiently waited for 6 weeks and given them multiple opportunities to them to deliver the agreed scope of work which they failed even after multiple commitments. From 6th June'2023, I am following up through official email for return of the amount. They are stating through WhatsApp that they will return but not responding to my emails. As my amount is hold for more than 10 weeks, need to share a legal notice for recovery of amount with interest.

A.Dear client,

If you wish to pursue legal action to recover the amount you paid, you can consider sending a legal notice to them. Here are some general steps you can follow:

Consult with a lawyer: It's advisable to consult with a lawyer who specializes in contract and consumer law. They can guide you through the legal process, review your case, and draft a legal notice on your behalf.

Draft a legal notice: Provide your lawyer with all the relevant details, including the payment made, the agreed scope of work, the delays, and any communication or evidence of their failure to meet their commitments. Your lawyer will use this information to draft a legal notice demanding the return of the amount you paid, along with any applicable interest.

Send the legal notice: Once the legal notice is prepared, it should be sent to M/s CV Designer through registered post or a recognized courier service. Make sure to retain proof of delivery and keep copies of all correspondence.

Await a response: M/s CV Designer will have a specific period of time, as mentioned in the legal notice, to respond and take appropriate action. They may choose to comply with the demand and return the amount, negotiate a settlement, or contest the notice.

Assess further options: Depending on the response (or lack thereof) from M/s CV Designer, you can discuss with your lawyer about potential legal remedies, such as filing a consumer complaint or initiating a civil lawsuit to recover the amount.

A.Dear Client,

On receipt of service charges, when a service provider fails to deliver the service within the agreed time limit that amounted to a deficiency in service on the part of the service provider. In the prevailing situation and watching the trend of their casual response to your multiple requests, you need to consult with an Advocate for the service of a legal notice to the service provider putting a mandate for response therein and on expiry of said mandate, you need to approach the concerned Consumer Commission of the District through filing a complaint petition against the Service Provider claiming refund of entire service charges with interest, cost of litigation and compensation for harassment and mental agony.
