I had completed my SSC from Banasthali Vidhyapith in 2020. There I had deposited 10,000 as security deposit which was completely refundable but they have not yet refunded it and are even not replying to my mails and when I visited the university I was asked to fill a form but nothing has happened so can I file a case against them in consumer court?

A.Dear client,
Generally the parry is supposed to send a demand draft which it hasn't. So please issue a legal notice saying if they don't act, you will file a consumer complaint

A.Dear Client,
A complaint under Consumer Protection Act, 2019 is required to be filed before the Consumer Court within two years from the date of the cause of action. Security deposit is refundable on completion of your course which you completed in 2020, therefore, a complaint for deficiency in service is required to be filed within the year 2022, so your claim is now barred by limitation u/s,69 of the Act. However, still you can file your complaint before the consumer fora with a prayer for condonation of delay in filing the complaint within the prescribed time limit stating authentic reasons/grounds that prevent you from filing the complaint within the time. In case the Court finds merit in your prayer your complaint may be allowed and an order shall be passed after hearing the complaint. Reach out to an Advocate for guidance and steps.

A.Dear Sir,
You may send legal notice threatening to file a consumer case for deficiency of service since they are suppose to send Demand Draft to your residential address when your Courts is completed in respect of refundable amounts.
