Company not giving me my incentive. Company not giving me my incentive.

Hi, I work in a company as a business development executive in okhla. It's a service based company. We get an incentive at the end of the financial year if we achieve the target. Last financial year i accomplished my targets and over achieved it and I was promised for an incentive at the end of financial year which was 31st March,2023 but it's been almost 4 months and the managers not giving my incentive even after several follow ups on mail, face to face conversation ( I have the recordings) they are not giving me any satisfactory answer and keep delaying.
I am seeking for an help/opinion about what should I do in this case where should I complain if they refuse me to give incentive?

A.Dear Client!

Incentive is a variable component in most company. Need to check your appointment letter as to how it is mentioned. If the target is achieved and the same is communicated to you officially by the company, then you are surely eligible for it.

A.Dear Client,
If the contract of employment provides you with that benefit on the basis of your annual performance appraisal, then on achievement or good performance report you are definitely entitled to get that incentive from the Company. But the performance appraisal report of an employee is treated as confidential and the prerogative of the management to fix the target of achievement that is entitled to an employee for the benefit. Based on verbal assurance you cannot claim the benefit from the Company as a matter of right. If you possess sufficient proofs that support your claim for the incentives, then you may escalate the grievance before the higher authority of the Company failing which you may file an application before the concerned Labour Commissioner for redressal of your grievance.

A.Dear client,

Review your employment contract and company policies: Begin by carefully reviewing your employment contract, any relevant policies, and the terms regarding incentives or bonuses. Make sure you understand the criteria for eligibility and any specific procedures or timelines outlined.

Gather evidence: Compile all relevant documentation, including emails, recordings of conversations, and any other forms of communication that demonstrate the promise of an incentive and your efforts to follow up on it. This evidence will be valuable if you need to escalate the issue.

Communicate in writing: Send a formal written communication to your manager, preferably via email, summarizing the situation. Include details of the promise made, the targets achieved, and the subsequent delays in receiving the incentive. Attach any supporting evidence you have collected. Clearly state your expectation and ask for a satisfactory resolution within a reasonable timeframe.

Engage HR or higher-level management: If your immediate manager does not provide a satisfactory response, consider reaching out to the human resources (HR) department or a higher-level manager in your organization. Explain the situation and provide them with copies of your written communication and evidence. They may be able to mediate the issue or offer guidance on how to proceed.

Explore legal options: If all internal avenues fail to resolve the matter, you may need to explore legal options. Consult an employment lawyer to understand your rights and obligations in your specific jurisdiction. They can advise you on the best course of action, such as filing a formal complaint with the appropriate labor or employment authority, or pursuing legal action.
