Care Taking Committee Decision Making Care Taking Committee Decision Making

HI,

In April 2023, we have dissolved the committee and it was decided to go ahead with the Election Process.
We are now a care taker committee. My understanding is, day to day Transactions like Federation Payment, Other Monthly Payments for Sweeper, Office Bearer, Security Guards etc, Insurance Payments can be done by Care Taker Committee.

But if there are minor repair works like Table Repair (approx 2300 Rs), Electric work in meter room (like 3000-4000 Rs) which are the works we cannot avoid, otherwise there will be a problem in the Society.
These were some emergency Problems that need to be addressed.

Also we were facing Water Shortage issue, hence we had to order tankers. 1000 Rs Per Tanker and approx we need 8-9 Tankers in a month for which we have to do Pre Booking.

My understanding is, these comes under day to day activities.

Do we need to take prior permissions from Registrar, every now and then for any work?

Or is there any other procedure we need to follow? Because there are few members, who are free and doing nothing, they keep objecting every single thing. Keep writing Notices to Registrar and all.

So if you could give us the right guidance for the same, that would be helpful.
I was the Secretary of the Committee which got dissolved in APril 2023

A.Dear client,

As a care taker committee, your responsibilities typically include managing the day-to-day affairs of the society until the new committee is elected.

Day-to-Day Transactions: Yes, the care taker committee is usually allowed to handle day-to-day transactions, such as payments for regular expenses like Federation Payments, Monthly Payments for staff (sweepers, office bearers, security guards), and insurance premiums. These transactions are essential for the smooth functioning of the society and can be managed by the care taker committee.

Minor Repair Works: Emergency repair works that are necessary for the proper functioning and safety of the society, like Table Repair and Electric Work, can generally be approved and managed by the care taker committee without requiring prior permission from the Registrar. However, it is advisable to keep proper records and documentation of such works for transparency and accountability.

Water Shortage and Tanker Bookings: Since water shortage is an urgent issue, ordering tankers for water supply is often considered a necessary day-to-day activity. The care taker committee should be able to make decisions and bookings to address this problem promptly. However, as with other expenses, proper documentation and accounting are essential.

Objections from Members: It is not uncommon for some members to raise objections or concerns. As a care taker committee, you should be open to addressing their queries and providing transparency in financial matters. Keeping clear records, maintaining open communication, and explaining the necessity of expenses can help alleviate their concerns.

Registrar Permissions: While day-to-day transactions and essential emergency works may not require prior permission from the Registrar, it's crucial to be aware of any specific regulations or limits set by the Registrar's office. Certain significant expenses or major decisions may require approval, and it's essential to follow the proper procedures as outlined by the governing authorities.

Election Process: Since the committee was dissolved, it's crucial to proceed with the election process as soon as possible to establish a new governing body. The election process should be conducted according to the society's bylaws and any legal requirements.

In summary, as a care taker committee, you have the responsibility to handle day-to-day operations and address emergency issues without necessarily seeking prior permissions for routine expenses. However, it's important to ensure transparency, maintain proper documentation, and follow any specific guidelines set by the Registrar's office or relevant authorities. If there are specific doubts or concerns, consulting with legal experts or seeking guidance from the Registrar's office directly can be helpful to ensure compliance with the law.

Thank you very much for your valuable comment. And you going out of the way to answer queries for free is really appreciated. Hardly anyone wants to do anything for social cause. If someone wants to do something, there are so many number of people who try to pull down.

Thank you again.
