I have been in relationship with a guy since 2019 in 2022 he got married to me and after getting married I got to know that he is already married and has a child. I have complained in police and as it was a muslim marriage the case was resolved with compromise. He left his 1st wife for 3 months and he stayed with me he harassed me mentally and physically he gave me tablets to get aborted and present he left without informing anything in the past few weeks he have been harassing me for not having kids while he himself got me aborted n number of times. He got me converted into muslim for marriage but never kept me as a wife. He left me in debt and also because I asked his help in clearing the DUES. He went back to his first wife and children taking care of them while I'm helpless and starving of food. How can I proceed to get a divorce and how to get justice in this case.

A.Dear client,
Please file a suit for divorce using cruelty as the ground. Cruelty refers to violent acts. However, a mere quarrel, petty outrageous behaviour or differences between the spouses does not come in the ambit of cruelty because this is something that is common in a day to day married life. Conducts that would amount to cruelty should be grave and severe in nature. Grave violence doesn’t always mean physical violence. Though physical violence is an essential factor that constitutes cruelty but apart from that a continuous process of ill-treatment or mental or physical torture to either of the spouse would also amount to cruelty.
