Child been humiliated in classroom
One of my student studying in class XI complained to me that the one of the lady teacher is constantly asking the child to look into her eyes but the child is not feeling comfortable in that. When the child do not follow what she says, she goes and complains to the principal about his disrespect. Is she doing the right thing??
A.Dear Client,
Under the Indian Penal Code (IPC), the act of sexually harassing a person is an offense. Section 354A of the IPC defines sexual harassment and provides for punishment for the offense. Additionally, the Protection of Children from Sexual Offenses (POCSO) Act, 2012 specifically protects children from sexual offenses and provides for stringent punishment for such acts.
While the specific actions mentioned in your query may not directly fall under the definition of sexual harassment, it is important to consider the overall context and impact on the student's well-being. Repeatedly asking a student to look into someone's eyes, despite the student feeling uncomfortable, may amount to inappropriate behavior and create a hostile or uncomfortable learning environment.
If the child is genuinely uncomfortable with the teacher's actions, it is essential to address this issue appropriately. As an educational professional, you should take such complaints seriously and ensure the safety and well-being of the student. It may be advisable to approach the school administration, such as the principal or the designated authority, to inform them about the situation and request appropriate action.
The school administration has a responsibility to investigate and address complaints involving the well-being and safety of students. They may need to assess the teacher-student interaction and take appropriate steps to prevent any potential misconduct or discomfort.
Thank you.
