I am Suresh residing in Delhi. And my mother lives in Chennai with my brother's family. I had given my valuable gold jewelleries and the fd's in the name of my father and me to my father when he was alive. he kept it in his locker for safety. Locker is of e or s type. My mother is of unsound mind, aged above 75 years and is eligible to open the locker. But my sister in law threatens and scolds my mother before me just because she talks with me. My brother is dumb and does not care about the family. Since, my mother is very fearful and unsound mind. She doesn't understand what is happening around her and is afraid of my sister in law. She does not allow me and my wife to see my mother or even talk with her. Recently I heard that she broke my mother's leg. Due to this, she is not able to walk and is bedridden. We gave a letter to bank not to allow anyone to open the locker without my permission because I am a legal heir. My sister in law challenged me that she would get the signature or thumb impression of my mother before her death and take all my valuable gold in locker including my mother's. Now, how should I save my mother from my sister in law and at the same time, how should I save my valuables in the locker. Kindly advice me can anything be done to save them legally.

A.Sir, the very first thing you should do is file a case of Domestic Violence and seek that your mother does not stay with that female as it is not safe for her to stay there and that there is also no one other than you to take care of her.
Having that said, In my opinion it is best to transfer all the valuable from that locker to a new locker which is only known to you and the access of which can be done singularly by you. By doing so, your mother can stay with you and you can look after her, also the valuables will remain in safe hands.

But sir,
My mother is of unsound mind and does not support us. Moreover, my mother is the only person who can open the locker. But, my brother blocked the locker saying that he is a legal heir. Now, how can I open the locker according to law?

Sir, for this you need to talk to the bank authorities [if incase they don't help you] then you might seek help from the court, because even you have your valuables there and that in itself is in danger. Secondly your mother being of unsound mind cannot take rational decisions and so it is in the interest of both that you are allowed the right to access that locker facility.
