My apartment consists of 32 houses wherein the same are shared between the landlord and builder in equal ratio. The builder has sold most of the houses and the landlord has retained all his houses and has let it out. The apartment is registered as per Societies Act. However, the builder who is the President of the Association is not abiding the rules of the association. He always wants to show his supremacy that he is the owner of more flats and decides as per his whims. It is very clear in the registered document of the association that even though he has 16 flats , it is one vote for one owner policy. He has occupied the security room which is a common area and has appointed a person for his personal needs. How can we get the same vacated. the local police are of the opinion that it is a civil matter and asked us to approach the court.

A.Dear client,
Approach the registrar and file a complaint. An apartment owner fails to comply with the Bylaws or the Rules and Regulations, either damages or injunctive relief or both can be claimed against him.
