Construction single room and bathroom on terrace

Can I make a single room and bathroom on my terrace if in my house agreement it,s written that the occupants of the said property shall have the right to way through the Staircase from the Ground Floor to Top Floor of the said property during reasonable hours only for the purpose all of repair, maintenance and up-keep of their over-head Water Tank, T.V.Antenna etc. etc. to which the VENDEE shall have objections.
