There is a vacant plot belonging to some private individual in my society and there are more than 40 houses constructed in the same society all having a common drain .That drainage water is flowing through the above mentioned plot for last 20 years , which is adjacent to Nalla/Khad where the drainage finally water falls . But suddenly after 20 years owner started construction in the plot and obstructing the drainage . It is also pertinent to mention that this drain was not constructed by the municipality itself but now this area now comes under the municipality what would be the remedy?

Any civil Construction requires approval from the competent authority that is Municipal Authority who approves a plan of construction following the rules and regulations in force and in accordance with a master plan that laid out the public roads, drainage, sewerage, water supply and other common civic amenities. So, in the given situation, you need to bring the matter to the notice of competent authority to resolve the issue failing which you may file a civil suit praying for an injunction on the ongoing construction.
