Upgrad refuse to refund my course fee
I have enrolled to a executive post graduate program in Data Science from november 2022.
In the month of may someone from Upgrad called and say i should go for masters which is a extension or articulation program there are numerous calls from different different persons from upgrad just to convince me so that i will enroll to their masters program which is cost around additional 2 lakhs and i have already paid 274000 towards post graduate programe
Any way they convinced me to go for masters articulation and i enrolled to the program which will start after Executive program and the masters course start date is 26 october 2023
Now i have raise a refund request before the course start date and they are refusing to return my hard earned money. According them this is a articulation program and is already merged with the existing prgrame according to them my course is already started from november 2022.
Now come to their refund policy
which says
"You can claim a refund for the amount paid towards the Program at any time, before Program
Start Date, by visiting www.upgrad.com and submitting your refund form via the "My
Application" section under your profile and complete the entire refund application process within
the deadlines as set out more particularly in ‘Table-A’ below."
In my masters application still there is aa option for refund which is according to their policy because the masters course has not yet started.
It's essential to carefully review the terms and conditions of the programs you enrolled in, both the Executive Post Graduate Program in Data Science and the Master's Articulation Program. Pay close attention to any clauses related to refunds, cancellations, and changes in program structure or fees. You may consider filing a complaint with Consumer Disputes Redressal Forum, if your concerns are not addressed by UpGrad.
From the contents of your query it transpires that after your enrollment in the executive post-graduate program in Data Science in November 2022, the institute insists you to avail master's program which is an extension or articulation program on the plea that the course is a merged program with payment of the additional cost of the program. In principle, a course or program cannot be started automatically before enrollment of an applicant, so their stand denying your refund of program fees amounts to unfair trade practice. So, you are aware of their refund policy, reach out to an Advocate for serving a legal notice to the concerned Institute and for filing a complaint against them under Sec.35 of the Consumer Protection Act, 2019 before the Consumer Court claiming a refund of the entire amount of tuition fee, along with compensation for harassment. A complaint is required to be filed before the Consumer Court within two years from the date of the cause of action.
