False FIR and False Chargesheet
I have two cases pending in my name. The first case is of Section 326, and the second case is of Section 324. I haven't committed either of the offenses. The guy has filed the FIR because I was helping a friend with whom he committed bigamy. The police have filed the chargesheet against all the accused (including me) for the first case, by getting involved with the complainant wrongly. Since this guy is doing this out of personal grudges, he got my Aadhar card from the investigating officer of the first case, and included my father's name as well in the second case, without knowing that my father had passed away 4 years ago.
1. If I go for quashing since the chargesheet is already filed for the first case, what complications might arise?
2. Will the 2nd case help me somehow in proving my innocence for the first case, as he included my father?
Both cases may be quashed if you go to High Court since you are having very good case on merits.
To quash the chargesheet filed against you in the first case (under Section 326), you will need to approach the appropriate High Court with a petition for quashing. It is essential to provide strong evidence and arguments to demonstrate your innocence and establish that the charges against you are baseless. The inclusion of your deceased father's name in the second case (under Section 324) could potentially be used as evidence to support your innocence in the first case. It could serve as a basis for demonstrating the false nature of the accusations and the lack of credibility of the complainant.
