Police enquiry report (after completion of enquiry) under RTI ACT
6 months ago
Can we ask Police enquiry report from the SHO with all reports collected by them after completion of enquiry on a complaint in respect infringement of property, under RTI ACT. If yes with relevant case laws
A.Dear Client,
You can seek information related to the police enquiry report and related documents as long as they do not fall under any of the exemptions listed under Section 8 and 9 of the RTI Act. If the information is sensitive, classified, or falls under any of these exemptions, the police may deny the request. The police may also deny access to information that contains personal or confidential data about individuals, unless it is in the public interest to disclose such information. One of the key principles in RTI applications is the "public interest" test. If the information sought serves a public interest, it is more likely to be disclosed. You can file an RTI application to the concerned police station's Public Information Officer (PIO) or the designated officer responsible for handling RTI requests. In the application, you should clearly specify the information you are seeking, including the police enquiry report and all related documents. Additionally, you should make a strong case for why the release of this information is in the public interest.
