sir,
we are nine brothers and five sisters from three mothers ,my father get marriage from my mother after expired my two mothrs ,my father given his self occupied /paternal property in 1966-67 to only six sons ,self and my mother and also given to me only self occupied agricultural land and residential plot but sold out my agricultural land . not given nay thing to my two brothers who born after this illegal partition and fixation/seprate jamabandi no .
kindly advice if myself and my two brothers will file partition suit than Is it possible to get paternal property which is sold out by my elder brothers ? what time it will take and what will be the expenses .

A.Dear Sir/Madam,
You will definitely get share if you file partition suit. Nothing to worry you will get result within 6-12 months as they will come and compromise.

Thanks sir for your prompt reply ,but there is some confusion as follow :
1. If my father has given share to yourself as well as my mother than can my two younger brother and myself will entitle for equal share from self occupied /paternal properties .?
2.my father has distribute properties in the year 1966-67 than Is it possible to file partition suit for equal partition after 52 years .
3.my father has given me only self occupied properties and sold out due to minor and expenses of my education etc. but he has given self occupied and paternal properties (grand father 's )to my six brothers .mother and yourself with separate jamabandi No./mutation etc. than Is it possible to get equal share of paternal properties .

A.U will not get sold properties to u back . Only u have right on existing properties

sir Thanks for your response but please let me know the follow :
1.If my elder brothers sold out the paternal properties (Grand father's )without equal and legal partition of my nine brothers and five sisters than the registry should be cancel after final judgement or should be adjust from their existing properties /residential plot or they should pay the market value .

But at the time Ur brother sold the property at that time if his karata of the family then not possible if not karata then take objections against them

no any my elder brother was my karta ,after death of my father in 1992, my mother was karta and after that my self is earning .
