Baby Surname Baby Surname

We are having a baby soon, and intend on keeping the surname of both mother and father for the baby ( hyphenated or double barrel). Is this legally okay in India and are there any legal implications of this in the short or long term. Also, will this result in any complications in future for the baby?

A.Dear Client,
The use of double surnames is legal but not customary. Children traditionally take on their father's surname (or, more recently, optionally their mother's). Hyphenating your baby's surname is considered a legal name change – meaning you can't drop your spouse's name or the hyphen in the future without having to go through a court-ordered name change. Double-barrelled surnames are comparatively common, especially in West Bengal, Traditionally, the first surname is paternal and comes from the father, while the second surname is maternal and comes from the mother. Double-barrelling allows the couple and their babies to retain the identity of both surnames.

A.Dear Client,
In India as per laws, it is legally permissible to use a double-barrel surname for your child, incorporating both the mother's and father's surnames. This practice aligns with the growing trend of acknowledging both parental identities. While there are generally no immediate legal implications, it's advisable to ensure that the chosen surname complies with any specific requirements or regulations in your state. It's also wise to check with legal professionals or authorities to understand any potential long-term implications. Communication and consensus between parents are crucial to avoid complications, and obtaining legal advice can provide clarity on the specific procedures and documentation to establish the chosen surname for your child in a way that aligns with existing laws and regulations.
