I'm a minor (17 years old) my father is not allowing me to study. He has given a transfer certificate application in my school and will not admit me to a different school. Can I take legal action against him for not letting me continue my education?

A.Dear Sir,
Through your next friend or legal guardian that is your mother you may file a case against your father.

A.Dear Client,
Legally, until the age of majority, parents are the holders of the education rights of their children. This means they are held responsible for educating their children. If the parents fail to discharge their responsibility, you need to contact an NGO that renders dedicated service for the education and upbringing of a minor child. Apart, you can make an appeal to the District Administration and the Chairperson, the State Human Rights Commission for necessary action in this regard.

A.Dear client,

Indeed you can take legal action as you have the right to education and if the father denies to pay or support your education a complaint can be raised through the help of your relatives against your father to provide maintenance and educational fees till you finish the age of 18 or till you finish your education.

Under section 125 of the CrPC a minor child can claim maintenance from his father, so you can file a complaint under the said section.
