Extended warranty of TV
TV bought from Flipkart with 2 years brand warranty, and at the time of installation, engineer asked me to buy extended warranty for around Rs. 6000. I paid that, and next day i received the invoice but no policy document was delivered to me. Requested several times to the engineer and even Flipkart, as engineer said the company giving extended warranty is Flipkart 's company but Flipkart is saying "Jeeves" is not there company they have a tie-up only with them. Then i contacted Jeeves for getting the policy documents after searching their contact details on google as they didn't mentioned their email and phone numbers in their invoice. When they sent the policy document on my request, i realised that the warranty is not extended and it is running parallelly with brand warranty. I requested them to cancel the policy and refund the amount then they said, policy can be cancelled within 10 days of issue date. I asked them how do i contact you to cancel when i was not able to verify the details shared by the engineer as you have not sent the policy document within the timeline, and also no contact details was present in the invoice.
So pls let me know if we can do anything in this case?
Insurance is considered to be mis-sold when the customer hasn't been given accurate information and advice about how the policy works. Insurance providers have to make sure the insurance policy they're selling is suitable for a consumer's needs and circumstances. Mis-sold insurance claims have become a vital avenue for seeking justice and recovering the funds lost due to unscrupulous practices. Almost, every insurance company gives a free look period of 15-30 days that varies from insurer to insurer. If you have identified the mis-selling within this period, then complain to the bank and the insurance company, and they will cancel your policy and return the premiums. If you have identified that an Insurance agent has sold you a misleading policy, after the free look period, you can write to the Insurance ombudsman and the insurer with all the proofs of mis-selling. The Insurance ombudsman will consider all the documents you have presented, and eventually, your policy will be closed. Regulation 22 (5) of IRDAI (Registration of Corporate Agents) Regulations, 2015 states that the corporate agent has to disclose to the Authority the details of specified persons (SP) along with their certificate number issued by the Authority. Insure can get his grievances redressed from the insurer directly, or he can register his complaints with the regulator IRDAI under the “Bima Bharosa system” (bimabharosa.irdai.gov.in). An aggrieved customer has multiple avenues to get his grievances redressed; he can complain to the Insurer, the Insurance ombudsman, IRDAI Bima Bharosa system and can approach Consumer Court claiming cancellation of mis-sold policy and refund of premiums along with compensation for harassment.
In this situation, it is recommended to first collect documents of all communication and gather evidence of the promises made by the engineer and the subsequent discrepancies in the extended warranty policy. Secondly, clearly communicate your concerns and the challenges you faced in verifying the details within the specified timeline. Thirdly reach out to Flipkart's customer support, providing a detailed account of the issue and the misleading information provided during installation. You can also reach out to Consumer Court in your region and file and complaint against the same. Provide them with the evidence you have collected and explain the breach of agreement and misrepresentation of the extended warranty terms. Additionally, check the terms and conditions of the extended warranty to understand if there are any clauses that can be leveraged in your favor.
You may get issue a strong legal notice threatening to lodge a consumer case and make it viral on social network.
