For my minor daughter - 13 year age, school is asking magistrate affidavit to update school records. DoB in birth certificate is correct but it got wrong in school record at the time of admission around 10 years back. We could notice this issue now when school teacher pointed to us that there is spelling mistake in name (letter 'a' was missing in name) which was corrected in latest birth certificate. How to get magistrate affidavit. I am residing in Rajajinagar, Bangalore 560010

A.Dear Sir,
You may just approach any Advocate practicing in City Civil Courts or Mayo Hall Courts and they will get an Affidavit from the Magistrate.

A.Dear Client,
As per law, you cannot rectify / change any content like name or DOB in the academic certificate after two years from the date of passing of the same. However, other documents can be corrected after submitting the proof of correct DOB with an affidavit and public notice in the newspaper. Following is the procedure under Births and Death Registration Act for obtaining birth Certificate:-
1)Apply to municipal authority for birth certificate as shown in certificate.
2)Municipal authority will give a certificate that no such birth is registered on that date.
3)Submit an application to the Executive Magistrate/Tahsildar/MRO for direction to municipal authority for birth certificate on the date mentioned in documents with following .
A notarized affidavit stating that you birth took place at home on the said date and the same is not registered.
“No birth registered certificate” issued by municipal
Notarized affidavit of mother and father (if alive) stating that you birth took place on that date and it is not registered.
First page copy of passport and education certificate of 10th. SSC etc.
Executive Magistrate/Tahsildar/MRO will give direction to municipal authority for issuing birth certificate.
Take that direction to municipal authority and apply for birth certificate on said date.
You will get required birth certificate on payment of Rs. 50/- fee to municipal.

A.Dear Client,
For updating school records with respect to the age, name, address etc of the student, an Affidavit in the form of a declaration to be typed on a Non-Judicial Stamp paper of appropriate value is to be sworn before the First Class Judicial Magistrate or Executive Magistrate. Get in touch with an Advocate with all the relevant documents you have in support of the desired correction for the purpose.
