We engaged a local photographer for my son's wedding..it has been 1year we didn't receive any photos and videos I hav been chasing every week... I paid 50percent amount at the time wedding...now he's asking remaining balance for designing purpose... How can I trust him???I'm mentally depressed with his behaviour and his bad service... So please advise me what are my rights here

A.Dear Client,
In the given situation, to resolve the issue at the pre-litigation stage, you may file a complaint against the errant photographer for deficiency in service before the State Consumer Affairs Deptt or District Consumer Protection Council constituted under the Consumer Protection Act and headed by the Dist. Magistrate where a consumer dispute is resolved through mediation/conciliation process which is time friendly and pocket friendly.

A.Dear Client,

Here the Photographer by not providing the photos and videos of the wedding has breached the contract between you and the photographer, Section 73 of the Indian Contract Act provides for the remedy where a contract has been breached.

Section 73 of the Indian Contract Act states that: When a contract has been broken, the party who suffers by such breach is entitled to receive, from the party who has broken the contract, compensation for any loss or damage caused to him thereby, which naturally arose in the usual course of things from such breach, or which the parties knew, when they made the contract, to be likely to result from the breach of it.

So, in the current situation first start with giving the notice to the photographer regarding his misconduct and with a warning that if within the given time period services which are due by his side are not fulfilled then a legal proceeding against him for the breach of contract under Section 73 of the Indian Contract Act will be initiated.

A.Dear Sir,
You may get issue a legal notice and initiate a case in Consumer forum and parallel to it you may approach Police and lodge a cheating case.
