What's the punishment under the Indian law for a married person having an affair , promise to marriage, sexual relationship with another unmarried woman.

A.Having a consensual sexual relationship between married women and married man is not a crime in India. Earlier it was a crime. Any married man and women can have physical relation with consensus in India. If , sexual relationship on making promise for marriage a unmarried girl is an offense and may amount to RAPE as her consent was taken under the influence of to marry. While , if you want to file a case against your husband for Adultery can be used as a ground for divorce, but with the latest change in laws of adultery, the adulterer cannot be prosecuted criminally. A.Dear Madam,
It is a very big offense like 376 rape etc., Breach of trust 406 IPC etc.

Section 376 in The Indian Penal Code
1[376. Punishment for rape.—
(1) Whoever, except in the cases provided for by sub-section (2), commits rape shall be punished with imprisonment of either description for a term which shall not be less than seven years but which may be for life or for a term which may extend to ten years and shall also be liable to fine unless the women raped is his own wife and is not under twelve years of age, in which cases, he shall be punished with imprisonment of either description for a term which may extend to two years or with fine or with both: Provided that the court may, for adequate and special reasons to be mentioned in the judgment, impose a sentence of imprisonment for a term of less than seven years.

A.As per the new laws, Adultery is no longer a criminal offence and as such the person who is the adulterer is cannot be prosecuted in any criminal cases for such act. However, it is still a criteria to take divorce and has civil remedies. Adultery can be used as a ground to take divorce but with the latest change in laws relating to adultery the adulterer cannot be prosecuted criminally. Adultery has been De - Criminalised.
