A.Dear Client,

The legal framework governing affidavits in India is outlined in the Indian Evidence Act, 1872. According to Section 191 of the Act, individuals bound by oath or affirmation to speak truthfully in affidavits can face charges of perjury if they make false statements. Perjury is punishable by imprisonment for up to seven years and a fine. Additionally, Section 193 of the Indian Evidence Act imposes penalties for knowingly making false statements in affidavits or other documents, with potential imprisonment for up to three years, a fine, or both.

Specifically, Section 191 of the Indian Penal Code (IPC) addresses the offense of filing false evidence, while Section 340 of the Code of Criminal Procedure (Cr. PC) outlines the procedure for filing a complaint related to this offense. Perjury is defined as knowingly submitting false evidence or affidavits before a court. It is advisable to seek guidance from a legal professional, such as an advocate, to navigate the matter appropriately and take the necessary steps.
