Neigbour harassment Neigbour harassment

Hi , my neighbours have been harassing us since three years. Each time we step out into our garden or too go out , they come outside just to make their presence known or send someone like car cleaner or driver who oggle at us, in a house of three females , one of them being minor and one a teenager. Their driver continuously stares at our house and whenever we step out , he moves the car just to create some sort of tension only to park it back within 30 seconds and not going anywhere. There is so much more that cannot be explain on text. We have multiple video proofs too.

A.Dear Client,

If a dispute with your neighbors remains unresolved through amicable means, and you believe it constitutes a public nuisance, you can take legal action. Here are the suggested steps:

1. Serve a Legal Notice: Consider serving a legal notice to your neighbor, clearly outlining the issues causing the dispute and expressing your intent to seek legal redress if the matter is not resolved satisfactorily.

2. File a Suit for Public Nuisance: You can file a suit for public nuisance under Section 268 of the Indian Penal Code (IPC). Public nuisance is an act or omission that causes harm, danger, or annoyance to the public or to people in general. Consult with a lawyer to prepare and file the necessary legal documents for this civil action.

3. Private Complaint under Sec. 200 of CrPC: Alternatively, you can file a private complaint under Section 200 of the Code of Criminal Procedure (CrPC) before the concerned Magistrate. In this complaint, you can provide details of the alleged public nuisance, and the Magistrate may order an inquiry under Section 202 of the CrPC.

It's crucial to consult with a legal professional before taking any legal action to ensure that your case is appropriately framed, and the correct legal provisions are invoked. Legal proceedings can be complex, and seeking professional advice will help you navigate the process effectively.

A.Dear Client,
If the dispute is not resolved between you and the neighbors fairly and amicably, then serve a legal notice to the neighbor, and file a suit for public nuisance against the neighbor for public nuisance under Sec.268 of IPC. You can also file a private complaint under Sec.200 of Cr. PC before the concerned Magistrate. Reach out to an Advocate for guidance and steps.
