My mobile phone was confiscated by the police in a false case. The charge sheet is filed 6 months ago. The case is triable by sessions court. And the case is in compliance stage since 6 months in the lower court as no party is pursuing the case. Do I have to wait for the case to proceed to file for returning of my mobile phone?

A.Dear Client,

Based on the limited facts that you have stated in your case, the trial procedure has to be over thereafter if the mobile phone is not required as evidence in the case then the court can order for the release of the phone subsequently.
