I made a comment to a post on a person's self facebook wall on 13.04.2024. My comment on the post was defamatory for the said person. Although my comment was true but it can be proved by documentary evidence. I deleted my comment within one hour considering that such adverse comment on social media is unlawful. Although my comment was deleted but the said person may have kept its screen shot. My question is in such situation may he initiate defamation suit u/s 499 of IPC against me ? And will such case be tenable at law ?

A.Dear Client,

Your remarks on social media, whether direct or indirect, can harm someone's reputation and lead to a defamation lawsuit against you. In a civil defamation case, the defamed individual can file a suit in either the High Court or subordinate courts to seek monetary compensation from the accused, as per Section 499 of the Indian Penal Code.

A.Dear sir
It is too remote to initiate defamation case as Indian courts not encouraging such cases. You just ignore the same whenever you receive any court notice then think over it and by going to High court it can be quashed easily.

Admittedly your comments against a person on social media directly or indirectly affect and damage the reputation of the person in society, attracting defamation suit against you. In a civil defamation case, a person who is defamed can move to either the High Court or subordinate courts and seek damages in the form of monetary compensation from the accused under Section 499 of the India Penal Code. If the person files a defamation suit against you get in touch with an Advocate for guidance and steps to resolve the issue amicably in the right way.
