Hello, Our grand father has three childrens in which the land has been equally partitioned "orally" by front portion(road), middle portion and last portion with a common way. in the middle portion the second son built his house 20yrs before. Now the last son who try to build house in front portion with proper registration, but the 2nd son who changed property tax and eb into his name without our knowledge which is in our grand father name. As he changed everything into his name is there any problem when i file case??
Please suggest. Thanks

A.Dear Sir,
File a suit for partition and seek deletion of entries in the name of that person.

If i file a suit for partition, can i get the front portion which my grand father partitioned orally??

A.Hello,
Yes, you may face many hurdles due to this. Since it is ancestral property, it needs to be properly, legally mutated among the 3 sons by way of partition deed, Registered will etc.
