hello Sir,
Mera ek married ladki k saath afair chal raha hai.uske husband ko humare affair k baare me pata chal gaya hai.wo ladki use divorce dena chahti hai to to uska husband use or mujhe jail bhejhne ki baat kerta hai.adultery k acase file kerne ki bolta hai.aap ye suggest kijiye ki wo ladki divorce kaise le..??? aur agar divorce leti hai to uska husband mujh per adultery ka case file ker sakta hai kya???
aur uska ek beta b hai to uski custody kisk pass rahegi ??? agar wo ladki chahti hai ki beta uske pass rahe or school fees ka pura expense uska husband uthaye.wo ladki b job kerti hai but itna nahi kamati ki wo pura karcha utha paaye to aisa possible hai kya???
plz suggest us...

A.dear client in your case i agreed on the advice given that In order to take divorce there are established grounds. What are the grounds in which your case is fit for divorce can be ascertained after knowing the full facts of the case. He can file a case against you for adultery as because you are having an affair with her after having knowledge that she is married. Even, if divorce case is filed he can still charge you with adultery because of the date of commissioning of offence. If the age of the child is less than 5 years, then she will get the custody of the child. If more than 5 years, then she will have to pray for custody before court of law. She will have to ask for maintenance by proving her income before the court of law and also his income. Please consult for any further advice in this matter.
