My husband harrsed me mentally and physically for 10,00,000lakhs. I complaint in PS. They called him over phone. He refused to come.. We don't want to file case that's why we take back case. My 2 year boy, certificates all are under his handover. I want my baby custody without filing case(not send him to jail).. Is there any possibility to get my certificates and child.

A.Hi client,
To get the best remedy out of your situation you need to take legal help.
You can complain against him in the police-station . You can file a case of Domestic Violence, 498(A) AND a lot more. The competent court will determine a number of facts like the financial status of you and your husband and give a remedy accordingly. And as your child is a minor he is supposed to remain with you.
So , suggestion would be to take legal help and hence appoint an Advocate.

A.You have to file case in Domestic Violence Act, this will not send him to Jail, and you can get Child custody and others. Without this case, no such possibility, unless he gives you without any condition

A.You can try having a meeting with your husband along with family elders. If nothing works, you have to file a police complaint or a case.

The mother usually gets custody of the minor child, under the age of five. but after five it can be given to any parent. various factors are considered while deciding custody petition like financial status, the welfare of the child, will/consent of the child, educational status, living standard, place, extra amenities, etc

The most important factor is the BEST INTEREST OF THE CHILD.
2. you can file a case of domestic violence against him for causing mental, physical and emotional abuse and can claim custody of your kid and maintenance for both.
