Drunk and accident

i was traveling on a bike with my wife. She is pregnant for 8 months. Suddenly a Auto(riksha) hit us from our behind.the auto driver was drunken. Me and my wife hospitalized with some injuries and we charge a case against to the driver for drink, drive and accident.Now we released from hospital. I want to know how can i move this case forward when i don't have a insurance for my bike at accident time.
My nike was not used from last two three years... because we where in abroad... now i renewed my insurance...
Please help me out from this issue...

A.1) You can file case in Motor Accident Claim Tribunal (MACT).
2) Therefore you must submit documents of criminal case pending or disposed from.criminal court.
3) You can get interim compensation in MACT case from opponent.
4) You need to file relevant hospital documents and receipts.
5) Insurance policy mis be active at the time of accident.
6) You can get compensation from opponent after filing MACT case.

If you want compensation then you must file an application before Motor Vehicles Tribunal before that please check whether any case was registered against the drunken driver and whether it was disposed or not.
