Dear sir one of relatives met with an accident by bike. The bike hitter is a minor boy so how can file a case against him?

A.dear client in your case First you have file a FIR in your Police Station of accident jurisdiction as per the requirement of Station Officer. For all claims of any nature the first requirement FIR. For Preferring the claim better to consult a Lawyer from the panel of Vidhikarya quickly.

A.Dear Sir,
At the first instance the guardian and then the owner of the vehicle will be held responsible. Compensation will be paid by the owner/guardian or insurance company as the case may be.

A.Sir,
The AIR report of the victim is enough for filing the FIR by the police and they will investigate the accident.whether Your relative is discharged from hospital or not.The police send the damaged vehicle to RTO for their report.After the formalities the police files the charge sheet to the court.
Your relative is also having right to file a accident compensation case (MCOP) before the court if the vehicle is insured with the insurance.

A.Has your relative sustained any injuries and incurred any expenses in treatment/hospitalization? Has the Police registered any case? If so, first of all obtain a copy of the FIR and proceed before the MACT. The driver being a minor, the Owner of the vehicle is liable.
