I have two children, one 3 years old and another 8 years old, so my wife saying u only keep both the children and for me my maintainance ,give me 25 lakh rupees,
And I am saying U keep younger one and I am keeping older one , but she z not ready. So what to do pls answer??

A.Either settle the matter by way of a MCD or else let her contest the divorce and you can contest it thereafter let the court decide. Your offers seem fair and the court can decide in your favor.

A.Dear Client,

assuming that a divorce case is oending between you both, let your wife formally propose a settlement through her lawyer. It is entirely your choice to agree to it or refuse it. You are also entitled to negotiate the terms you want. Unless you hear it from her lawyer, do not entertain any settlement talks with your wife.

Even if there is no pending divorce case, you may wait until your wife initiates settlement talks through lawyers or family elders.

A.Dear Sir,
She wish to be free bird and may marry some one else after taking Rs.25L. Just postpone the matter. Never accept such proposal.

A.you have to mutually settle the matter with your wife or can take a counseling session, through which a councilor/lawyer will try to convince her for the same,

if you opt for the mutual divorce any time,
don't forget to draft an MOU before approaching Mutual Divorce, which is the most essential and important part of a Divorce case,
some basic points to keep in mind and put in writing through an MOU before filing the petition for mutual consent divorce are custody of kids, distribution of assets (movable/immovable), quash/withdraw of pending litigation if any, Maintenance (present/future), Alimony, mode and time of making the payment, streedhan, future litigation, etc.
