icon Death Certificate

Is the Death Certificate issued by the United Republic of Tanzania valid in India?

A. Hi, it is important to get an apostilled for death certificate as the lawyers will need an apostille attached to the deceased‘s death certificate if the document is to be used in India (for transfer of deceased's fund or property). You can arrange to get an apostille death certificate within five working days after the death is registered properly in the appropriate registry office. The Apostille stamp is issued by a recognized government body and without going to the consulate.

A. Hi, this is not a classic case of receiving the wrong product and then asking for exchange / refund, since you accepted the delivery of product expecting a refund for the subsidized amount (did the seller himself promise to refund the amount?). The validity of this transaction depends on the terms and conditions of the company you ordered it from (assuming it to be an e-commerce website) and also the specific seller's term and conditions. If according to them, this is a valid demand, approaching ...ReadMore

icon False case of 345 B

In March 2 person looted my house (1 lakh) then my mother did a police complaint now to counter that case or to build pressure on my father they have done a fir with 354 b section. Now what should we

A. Hi, if a false FIR has been lodged, then under section 482 of CrPC, you can approach The High Court by filing an application for the quashing of the false FIR and The High Court, if convinced that the FIR has been falsely implicated, can use its Inherent power under Section 482 Crpc to quash the FIR.
Other option is to continue fighting the case in the lower court itself, but first get an order for anticipatory bail, or regular bail if charge sheet is already filed.

icon Release deed

3 blood sisters nominees in property, father (owner) deceased. 2 sisters want to relinquish their name from nomination by release deed. How to show consideration, will it attract stamp duty?

A. Hi,
For a Release deed to be legally acceptable and valid, it must be registered. When such a deed is registered, the stamp duty is paid. However, showing the payment of consideration would change the form of the release deed to a sale deed which would attract more taxes.

I solely purchased a property(2005) owner left me a will. I let my financially weak bachelor brother stay in a room on my house without any rent. He got married, he & his family is forcefully occupyin

A. Hi, since the property is not in your name fully, it will be difficult successfully evicting your brother and his family. The second complication arises by virtue of your brother living in this house for 15 years, he may take a claim of adverse possession.

A. Hi, student of your college should engage a legal counsel collectively who may be willing to represent your case in the appropriate court. There are numerous institution that have granted a waiver in college fees to some extent in view of the adverse impact of COVID-19 on many parents' incomes. Some institutions have also waived off any late fees in this regard. These may be used as strong examples to strengthen your case.
