icon How to avoid entrance of my wife in matrimonial house post filing divorce

Dear Sir, I have filed divorce case against my wife and have informed her. At present she is living in her parental house for last 15 days. We have kept our home (Matrimonial house) locked since then

A. Hi,
A married woman has the right to enter her matrimonial home as much as she has the right to enter her natal home. There is no legal provision as such to prevent her by entering the matrimonial home. Even trespass wouldn't stand since she has the right to enter the property. Only after the divorce has been decreed can you get a restraining order.

icon No salary paid to intern

I worked as intern at a company after getting their work done they kicked me out and didn't pay my salary

A. Hi,
1) You need to check the employment letter/internship letter for the terms and conditions regarding the stipend during internships.
2) If no salary was mentioned, then you are not entitled to get the benefits.
3) If a stipend was promised, then you can send a legal notice to the company and claim your salary.

icon My wife is making me mentally disturbed by thinking wrongly about me.

What can I do now? Shall I file the police complaint first?

A. Hi,
1) You can try and sort this out amicably by talking to her and clearing any misunderstandings.
2) You also have an option to file for divorce on the basis of mutual grounds if things get really hard.
3) Suggest you to seek help from a therapist and consult a councillor to help fix your marriage.

Deceased daughter children's when can't claim ancestral property of the mother

A. Mother's ancestral property cannot be considered as ancestral in the hands of children so mother's share in her ancestral property will be considered as self acquired and the mother is entitled to transfer the same in registered manner to any person of her choice and her deceased daughter's children cannot raise any objection.

I've been staying at an rented apartment in Punefor 15 years and the first, 11 months rental agreement executed in 2006 was never renewed or re-registered. The landlord lady passed away an year back

A. Hi,
Since you have been staying there for more than 12 years, you can use the defense of adverse possession. Adverse possession may be a term that’s utilized in our legal system when someone acquires ownership of movable or immovable property by continuous use of it. Please contact a lawyer for further advice.

A. Hi,
Since you have married under the muslim personal laws, then the muslim laws will apply accordingly. As per the Muslim Personal Law the mother is entitled only to the custody of the person of her minor child up to a certain age according to the sex of the child but all other purpose father is the legal guardian. icon Will the GPA cancellation of first holder impact us and we no more hold the right to land?

A. Hi,
1) Cancellation of the GPA does not nullify the earlier actions taken by that GPA holder. In your case, the sale is valid and you still hold rights over it.
2) When a sale deed has already been executed over a land, any subsequent deals selling the same piece of land by the previous owner is null and void.
Thus, you have no reason to fear.
