I've become member of Maintenance co-op Society which was formed since last June 2017. The application form on which I had signed mentioned mentioned heading of co-op housing society. But when society was formed it came under maintenance co-op society? I had given resignation letter from society membership which society refused to cancel my membership. So, i approached sub-registrars co-op society court they told me that 'Maintenance Society Membership is Optional". Society cannot force me to stay as it's member. They should accept resignation. So, there was hearing between society and me in co-op court. Hearing is complete on 5th April 2018 still the court has not given any order copy. The sub-registrar is telling that will give on saturday so now 5-months completed no order till now and i'm tired of following co-op office. The reason for my resignation was that society was asking me monthly 2000/- and others 200/- and was against my Paying Guests and insisted me to keep family!!!! 1) Can i file cheating case against maintenace society because they took signatures on CHS form and society was formed as Maintenance Co-op society? So that society license is cancelled. 2) why is co-op court not giving verdict since hearing has been completed since last 5-months? 3) Will society convert it's 'Maintenance Society' into 'Housing Society' by giving monetary or political influence to sub-registrar?

A. You have not stated which state you are in. Take the help of a lawyer dealing with societies matter, you have an appeal to Assistant Registrar or Deputy Registrar, cannot go to High Court directly.

A FIR has been filed against us in Tatisilway Police station on 04.09.18 under 448/313/427/504/506. Now on 15.09.18, we have received a notice under 41a to appear before IO in Tatisilway station on 18.09.18. I want to know how to proceed in this? There is no time to go for any anticipatory bail. Further this IO is working against us from long ago in past. Other party had lost a land dispute case against us recently and from that time they are harassing us and threatened to drag under a different case. We had gone multiple time to police station to file our FIR but they denied and told to go in court. Please help us .

A. You file anticipatory bail instead of going to the station on that date. Avoid him till you get bail. send your e mail id for further idea.

I applied for the post of assistant professor according to the eligibility criteria given in notification. There m.phil holders prior to 2009 were eligible. But now the recruitment board is not taking them. I have qualified it's written exam with good marks and secured my name in the merit list. Plz give a legal advice.

A. You can challenge it only if they take lesser qualified persons instead of you. But if they do not recruit that post at all, you have no case.

I want divorce from my husband. I have two daughter, one is 5 years old and other is 1 year and 2 months old. I got forcely married at the age of 16 and my husband and his family makes false documents in which they showed my age 18 uears but i was 16 years at that time. I suffered lots of harrasment and voilence in that family. I also faces physical harrasment. Now 1 am 23 years old. I loves a guy but i didn't make any physical relation with him. I have a step mother who not loves me ,it is the reason that my parental background is not good. I want a divorce and my little baby who is 1 years and 2 months old. My husband always hurt me physically and making only physical relation. Please advice me how can i take divorce and he is not ready for divorce.

Hi I am a 26 year old boy, belong from a middle class family and I am studying for government job. There are a man contact with my mother and proposed him that he give me job for money. My mother is a house wife and not educated. So she trust him and gave him 97000 in part by part. After skipping so many day we are under stand that he is a fraud. Then we asked for the money return, after few days they give us a cheque but it was bounce(we have that cheque and recorded that he owed me that money). But it was 2 year from then he return us nothing. He is not coming in his own house, on asking to his families they said that they can't help us about it find him and ask him.Other side he fooled too many peoples in the West Bengal including one of my maternal uncle around 280,000. His name NIRMAL MAJUMDER from sodepure, madhyamgram, kolakata, West Bengal. Please help us to getting our money back..

My wife has filed RCR case against me and she has used some false documents in her petition under affidavit. What is the procedure for filing section 340 and does the court take seriously the use of fake documents in family civil cases ?

A. Court is court and false affidavit is a serious matter. But why you have to fight RCR case ?

I sir/madam, I am 31 yrs old lady living with my parents currently. I have a 1 sister n brother, and I'm the only earning person of my family. My father is pensioner with 2k pension monthly.he took a loan from 1 lady who lives nearby to our house which was around 4L when he was working for which he haven't made any legal document that he is taking this amount from this lady, and when he got retired from his job so all pension which he got from his entire service he paid entire loan amount with interest, in which only 75k was pending that time so we told her we will pay it later 1s we have some cash, but while taking loan as thr r no legal documents r made while paying her back also we haven't made any legal documents.but now that lady visits our house ever now n then standing in door only use bad words towards my family I want my money back and it's around 6L now. So give me your house if pay such amount, she also humiliate us while on road also, use bad words towards me n my family. My mom is already a heart patient my dad is above 60. I tired of her behaviour, I'm lot frustrated also. I don't know what to do, plz help me

A. give a written complaint to local police with complete narration of all these. Asking Police to stop harrassment from her. keep an endorsement of the complaint and a copy. Ask the police to tell those people to go to Court.

Respected Sir/mam, I have been married since 3 years. Last year July i got to know that my husband was having an affair with his colleague from the very next month of our marriage. Last October he broke-up with her after lots of drama from the girl's side. ANd took the decision to do navy job. I asked my parents for financial help. They gave the entire course money. Now the condition is that i have been working from last 9 months since he isn't working. And he is staying with his parents in his village leaving me alone here in kolkata. His mom is a witch, she usually brain washes him to remarry & divorce me. And he is totally a mama's boy. Since one month he has not returned from his village & neither msgs or calls me. I did so many things for him, but he forgot everything. I do not want to divorce him. But he is not at all concerned about me . Pls suggest what legal steps can be taken. Regards Saanjh

A. You can file a suit for restitution of conjugal rights. But it is difficult to enforce even if you get the order. TO put some pressure on him you can file other cases and privately send words to him that you will withdraw them if he comes for a compromise.

I have purchased land through a dealer and give amount to him through cheque and dealer paid this amount to orignal owner through his cheque. Know I want acknowledgment of payment from owner. So kindly send me some legel format on which I could take receipt of payment from owner.
