A.Dear concerned,
You have a number of legal remedies available to get rid of this kind of critical situation. You can file a case of bigamy u/s 494 of IPC, if your husband has married to that other lady. Meanwhile, you can file a petition u/s 125 of CrPC, if he is not even giving you the maintenance. You can file a case of domestic violence as per the provisions of PWDV Act. You can file a case u/s 9 of the HMA for the restitution of conjugal rights, if you want to live with him. On the other hand, you can also file a divorce petition u/s 13 (1) (i) of the HMA, if you don't want to live with him. For more information, you should contact a good legal practitioner from the Vidhikarya platform having specialisation in family matters.

Husband having extramarital affairs is one of the grounds for divorce.But you have to prove the extra marital relationship.If you want a divorce, then it will be possible.If the husband agrees for a divorce with mutual consent it will be faster.Otherwise it will take time and will be processed in a routine manner.You decide coolly what you want.Once you take the decision, action will be faster.Thanks .Shanti Ranjan Behera Advocate

A.Adultery is not a crime any more even if that lady is married. But living in adultery is still a grounds for Divorce. So, please decide what you want and take steps based on that.

If you want to go back to his house, file a petition for restitution of your conjugal rights. If you want divorce, please file a petition for divorce. If you need money, file a petition for maintenance. Also, you can ask for right to residence under DV Act. Please approach your district protection officer for that.
