After 24 years of marriage, my wife wants to file a false case under 498a. Is it permissible. I am not even on speaking terms with her.

A. Sir You can file a written complaint to your nearest police station indicating apprehension of false complaint which can be filed by your wife. Dear sir, My mother in law have building of 4floors including ground floor..wen my father in law was alive nd my husband was bachelor he gave his father 15lac for making 2nd floor for him nd his father said dat is for us my husband nd me wen I came after marriage .my marriage is love marriage.mmy mother in law she never accepted me.now she is threatening me nd my son who is 1.7yrs old dat she will kill us. Now the prblm is she is not giving the 2nd floor which he was an investment of my husband she is asking to leave nd threatening us She is giving to elder brother in law everything.she doesn't want to keep us in dat house..pls suggest how should we get dat floor where my husband has invested.the whole house is in name of my mother in law.pls suggest

My sister has started a cloth shop with a lady friend and financed the business by taking a shop on rent and buying stocks etc. After a few months the friend has said that she can manage the shop on her own and will pay back the money in installments and she does not need my sister's association any more. She and her husband are not financially strong and cannot pay back the money regularly. She has ruthlessly cut off my sister from the partnership and we dont trust her. How do we recover the money invested in the shop or get back possession of the shop. No partnership deed was prepared.

A. Sir/Madam How was the mode of transfer of money? You can file a criminal complaint in your nearest police station or else file a civil suit to recover the same or simultaneously can do both but preferably criminal action is much more advisable as civil remedy takes time .

Hello Sir / Madam Good evening. I had altered my name through a Maharashtra Government Gazette. Based on this, I had requested my Housing Society to effect this change in the Share Certificate. However, they seem to be having a different view in that the housing sale deed has to be re-registered. Can I have your valuable advice in this regard. Thanks and regards.

A. Sir/Madam The sale deed does not have to be re-registered. You will have to give a public notice stating that your name is changed. After the public notice you will have to approach the sub registrar with whom you have registered the agreement under the previous name along with the public notice and the official Gazette which shows the name change. He will make the necessary changes in the records and issue a letter or a copy of the page in which he will make necessary changes as regards your name. You can then submit the said letter to the Secretary for issuing a new share certificate.

I am married with 1 kid . I live with my parents. I pay all expenses of house & of my parents and also pay 4000 monthly to my parents for their personal expense. Now they want 6000 pm. they say if I don't give them more money they will give this house on rent. And I should move from this house. Do they have legal right to ask me to go away? Or do I have legal right to fight against such injustice.

I married in Nov 2016. Have a baby; 10 months old and diagnosed with Acute Leukamia. To avoid medical expenses, my husband simply left me to handle the situation alone. I am unemployed. The child is undergoing chemotherapy. T Do I have any legal possibility to handle the situation. In case of divorce, am I entitled to a right to properties belonging to my husband?

A. Madam You can file maintenance proceedings under the Domestic Violence Act in the concerned Magistrate's court and also claim maintenance under section 125 of Cr.P.C. In case of divorce you will be entitled to alimony which is decided by the court or may be mutually decided between the parties.

A person borrowed some money frome me he gave a cheque and will be paid in certain time.Im not received the money. I was produced the cheque to bank. Bank give us a memo which reason qouted that insufficient funds in his account.I given notice regarding cheque bounce. Still not received the money within 15 days he is not lifting the mobile Please guide me what action should i taken.

A. Sir You need to file a complaint and initiate action under section 138 of the Negotiable Instrument Act in the nearest Metropolitan Court within 30 days from once the notice period of 15 days given by you has expired. You can also file simultaneously a written complaint in the nearest police station to register an FIR under section 420 of IPC for cheating.
