Prior to partition, that property was self acquired property of your grandfather so as per definition of ancestral property supported by Supreme Court reference, it was never an ancestral property prior to Partition and. therefore, your elder brother has no legal right to claim it as his ancestral. You have all the rights in the property, however, please provide all the legal documents of the property including gift deed.

However, As per Section 13 B of the Hindu Marriage Act, 1955, and Section 28 of the Special Marriage Act 1954, both parties can file for a mutual divorce only after living separately for a year. After this period, a court may prescribe another 6-month cool-off period as well.
