A. Hi,
Until the process of CIRP is completed there won't be solution to your issue. You can take the possession if possible and put it on rent or sale according to your financial standing. If not then you can submit your claim to the resolution professional and become a member of the committee of creditors of this company but you will get your share only when the whole resolution process is completed.

Hello, a few months back I signed on a white paper. However, when I searched for it later, I found that the paper was missing. Will there be any legal issues with a missing blank paper with my signatu

A. by mere blank paper, assets doent come in danger but you can.

does that paper had address also with signature.
if you lost it outside then person have to know whose signature it is.
if some relative took it then you can be murdered with that paper as suiside note.

A. Hi,
1. So long as it is outside your property, then their right to livelihood is guaranteed under Article 19(1)(g) of the Constitution, and you cannot stop them.
2. If you can prove that their stall has caused loss to your shop, then you have suffered a legal injury and may file a tort to be compensated or have them removed from the area.
3. If it is not inside your property, then they are free to do as they want.

icon Child custody

My daughter aged 11 years want to stay with her grandmother on her own wish, without our permission,do law allow her to take own decisions?

A. Hi,
If your spouse and you are in the middle of separation proceedings, then the Guardians and Wards Act provides that children above 9 years must be heard when it comes to their preference of where to stay. However, if you are not separating, then the child is under your guardianship till she is 18 years old, and you may take a decision of your choice which you believe is in her best interests.

A. Hi,
I'd advise you make a report to the police immediately. You can seek protection under the Protection of Women from Domestic Violence Act and also under S.498-A of the IPC, which deals with cruelty.
With regard to the house, you shall have to look into whether your husband made a will in this regard. Your son and you are both your late husband's rightful legal heirs, but so is his mother. She does not have a very good chance of throwing you out as you have just as much right to claim the hou ...ReadMore

A. Hi,
In general, if there is a Government order stating that persons with equivalent qualifications could apply for the same posting, then those qualifications can be accepted by the PSC. However, we might have to look into this order in-depth to give a more detailed response.

A. Hi,
Yes, as long as you were on the company's employee roll, you can ask for the past 4 months' salary. I'd advise you to intimate to HR that you are ready to take legal action if the issue is not resolved by them.

Do advocate have rights to restrict his client to go court and inquire about case status and details.

A. Hi,
No, advocates have no such rights.
It is only in certain special circumstances in cases of a sensitive nature that the Court may find that the client needs to be shielded from some aspects of the proceedings. This is the exception however, and not the norm.
The general rule is that a client has a right to know everything that is going on with his case.

my in laws took my kids without my permission so which action i can take against them my husband is in abort he is aware of this.

A. Hi,
I'd suggest going to them yourself and bringing your children back with you. If that fails, then you shall have no choice but to file a complaint with the police. If your husband is abroad, then you are considered the children's sole legal guardian and as such, your permission will be needed before anyone takes your children away.
