A. Hello Sir,
According to Order VII Rule 10 of Civil Procedure Code,1908 when there is a defect in jurisdiction so that continuation of proceedings of such suit is not possible, such suit can be returned to the court of competent jurisdiction at any stage when such defect comes into consideration.
You can reply to the court by saying that you were not the part of chaos and the legal notice is wrong.

You need to get correct name published in the official gazette of India and also by publishing in any national newspaper and then that can be used as a proof to get rectified wrong name in all other relevant documents i.e. Aadhar Card, PAN card etc.

U may try to get an endorsement from the Tamilnadu RTO that the said original DL was lost in transit. Otherwise, u may file an Affidavit narrating all the details and try to get duplicate DL.
