1. File a money recovery suit against him, the police will help you locate him.
2. A suit can also be filed against the company.
3. Yes, and also a complaint for fraud and cheating under Sections 415 and 420 IPC.

A. Hi,
He can be punished under your state's Money Lenders Act. It is a punishable offence to lend money for commercial gain without a license.
You can also complain to the police about fraud and cheating under Sections 415 and 420 IPC.

A. Hi,
You will have to file an execution petition against them after the decree is passed. The Court will pass the order and then the police can recover the amount if they refuse to pay.

A. File a FIR for cheating & send her in jail, about the money file a separate recovery suit. Appoint a good lawyer so that the bail of the lady will NOT be easily possible.

While you are a party to the suit, you can claim you were unaware of the company's bank statement at the time of signing the cheques. The lability is ultimately borne by the company itself.

You can argue that you were unaware of the company's finances and as such, are not liable for the same. The punishment will be given to the company as it is a legal entity.

A. Hi,
According to Section 138 of the Act, the dishonour of cheque is a criminal offence and is punishable by imprisonment up to two years or with monetary penalty or with both. If payee decides to proceed legally, then the drawer should be given a chance of repaying the cheque amount immediately.
