A lady has taken 10 lakh rupees from me for giving government job and given me cheque, lawyer has wasted time limit of cheque to file 138 case, lady is in jail she is not ready to give money back, she has eaten all the money, she doesnt have, telling lia, she is ready to go to jail, in this circumstance how 138 case or recovery suit will recover money from her

A.File a FIR for cheating & send her in jail, about the money file a separate recovery suit. Appoint a good lawyer so that the bail of the lady will NOT be easily possible.

A.Hi,
The money will be recovered from her other assets that will be liquidated by the Court. You can file a money recovery suit if the limitation period for a cheque bounce case has expired.

A.Hi,
They will recover the amount from her assets. You can proceed with whatever option is more convenient for you, the outcome will most likely be the same.

A.if the cheque can be presented in the bank again, then do so and get the same dishonored again and initiate the proceedings u/s 138 of NI Act.
if cheque cannot be presented in the bank again then file the recovery suit after giving a proper legal notice.
