A. Dear client,
They have every right to ask for the EMI from you. However, they cannot harass you into paying the EMI. You can file a legal notice and send it to them. But, since you are the one at fault in paying back the EMI, it may be tough to claim them constantly contacting you was 'harassment'. Instead, you can write a letter explaining your financial situation to them and ask for more time to repay the EMI.

A. Once you take a loan then you need to repay the loan. Speak to then and try to reach out to some settlement asking them to reduce the amount that they would have got after selling the bike and rest you can pay them in installments.

A. You should not have started a business without having proper documents and agreement. For want of these docs you may to bear all loss to yourself and pay him back the money. What you can do is get in touch with a lawyer and prepare an MoU signed by you and him wherein you say that you will pay the amount gradually and he should not trouble you.

1) You can personally appear, there is no hard and fast rule concerning appearing with a lawyer.
2) However, a lawyer can help you put forth your grievances and the remedy you seek in an articulated manner and can also be beneficial in handling the procedures and other work at the Low Adalat.

A. Hi,
It is unfortunate that the person whom you have given your money too has absconded. However, since you have a promissory note which is valid, you can get your money back by approaching the court and filing a money suit. This will help you get your money back

Can directors be personally liable in a nidhi ltd company. They collected FD deposit from public and malpractice it.

A. A directors liability is limited to the share that he has subscribed to the company whether it is nidhi limited company or private limited company. But if a company engages into a criminal or fraudulent activity, like satyam computers, then the liability of the directors are unlimited that means the directors will be taken to custody and the case will be opened against them too.
If the Directors knew about the malpractices or authorized the malpractices then they will go behind the bars.
Borrower absconding and EMI is paid by Dad, what are the options?

A. Dear Sir/ Madam,
First go to the police station and receive a declaration from the police station that your brother cannot be traced then report the same to the bank and wait for their reply. If the reply is useful you can proceed with it or else just stop paying the EMI and let the bank proceed with their course of action
