A. File a petition for divorce under section 13B of Hindu Marriage Act,1955. If he appears before the court in that case it is file or if he doesn't appear you will get ex parte decree of Divorce.

A. Though you cannot be forced to go back to him ( Saritha`s Case), you will have marital obligations and can be made to attend courts. if you do not want to re marry, you can leave to a different place. A decree of restitution of conjugal rights cannot be enforced on you.

A. dear client in your matter best remedy is divorce by mutual consent if you are a Hindu by religion. It will only take 6 months for taking divorce by mutual consent. If you can manage a divorce in Australia do it as divoce is easier there.

A. dear client in your case i agreed on legal opinion that There are no examples of Court having granted any divorce on the ground of wife or husband having affairs prior to marriage. But with some effort and careful drafting you may be able to succeed.
