A. dear client kindly consult with your lawyer and ask your conducting advocate can do the necessary amendment by filing an application under Order 6 Rule 17 read with section 151 of CPC seeking amendment in the plaint. No need of any precedent.

Calculation of interim maintenance with loan

Hi, My wife filed RCR with interim maintenance application. If I take a car loan now, will my loan emi deducted from my net income per month before calculation of interim maintenance amount ? Thanks

A. dear client If you take a loan, you have to pay with interest. your Car loan is your personal loan. Court cannot calculate it . your duty to pay maintenance to the wife.
