Sir
Main 35 sal ki aurat hu, meri shadi ko 8 sal huye or mera pati muje chod ke 4 sal pahile chala gya, muje 4 sal ka ladka hai,mera pati kaha gaya pata nahi maine police me camplent darj kiya lekin Kuch bhi nahi hua,to maine Mahila aayog se help magi To police or mahila aayog ke logo ne muje Mere pati ka address mang rahe he or tabhi age ki karyvahi karenge,ab mera pati muje chod ke kahi chala gaya mai uska address kaise Laungi.mere Ghar valo ne mere liye naya Sadi ka Rista laye hai.mai apne baccche ke bhavisya ke liye usse shadi bhi kar lungi lekhin mera pati vapas aaya or bacche par apna hakk jatane laga to mai kya karungi,
To Agar baad me mera pati aaya or mujpar or mere bete par Police me shikayat diya to mai kya karu,Pati se Legally apne Husbend ( jo nahi hai) usse Kaise Divorce lu.
Plz help me sir

A.dear client you can remarry after completing some formalities as established by law to be in the safer side.

A.डियर क्लाइंट आपके पति का पता लगाने के लिए यदि आप हाई कोर्ट मे भारतीय संविधान के अनुच्छेद २२६ के अंतर्गत बंदी प्रत्यछीकरण यानि हैबियस कार्पस की रिट याचिका लगाती है तो उसकी सुनवाई २४ घंटे के अंदर ही हो जाएगी और एक महीने के अंदर ही पुलिस को आपके आदमी का पता लगाने का आर्डर हाई कोर्ट के द्वारा दिया जायेगा .
जंहा तक मुकदमे के खर्च और वकील की फीस का प्रश्न है तो यह बात इस पर निर्भर करते है आप किसे अपना वकील करती है और वो कितनी फीस मांगता है .

A.डियर क्लाइंट आपने आपने पति के गुमशुदा होने की रिपोर्ट पुलिस मै दर्ज करवाई है और महिला आयोग से भी शिकायत की है और पुलिस आपके गुमशुदा पति को नहीं खोज पाई है तो क्या यह सभी कागज आपके पास है या नहीं यह बताइए .
यदि यह सभी कागज आपके पास है तो आप हाई कोर्ट मै बंदी प्रत्यक्चिकरण यानि हैबियस कार्पस की याचिका लगाइये तब हाई कोर्ट के आदेश पर पुलिस विभाग एक महीने के अंदर ही आपके पति खोज कर हाई कोर्ट मै पेश कर देगा .
अभी जल्दबाज़ी मै आप दूसरी शादी मत कीजिये . इस समय आप आपने पते की पूरी सम्पति की मालिक है इसलिए आपका और आपके बच्चे का भविष्य सुरछित है . आपकी पहले पति से बिना तलाक लिए दूसरी शादी गैर कानूनी होगी और आपके दूसरे पति की सम्पत्ति मै से आपको कोई हिस्सा नहीं मिलेगा . आप दुसरे पति की रखेल मानी जाएँगी.

Sir mere pass Police me Complent ki Hui copy hai or Mahila Aayog me Di gai camplent ki bhi Copy hai,
Sir Agar Mai Court me Jaungi To Kitne tak ka Kharcha Aa sakta hai.
Or kitna samay lag sakta hai.

A.file a divorce application on the ground of cruelty and desertion since your husband disappeared or deserted for 4 years. You cannot remarry without dissolving your first marriage.

A.Dear mam if Ur husband never found in 7 year then law presume as his die . If Ur husband return . Then u have right to ask him . Where was u till now. Husband have duty against his family to provide shelter and food . Or other amenities.
