Company issued termination letter not shown any proofs. Wrong allegations based like used abusing words and caste related words but u never used above words.

A. Facts not clear. You did not mention what is your designation. If your employment falls within the definition of the Workman then approach the court under Workmen Compensation Act, if your employment does not fall within the definition of Workman approach the court under the Shops and Establishments Act.

Our bank want to cut down employees due to they moving some process in other city. Due to.which they cutting staff strength by giving excuss that they are not capable or incompetent . There are people who work 5, 6 ,7 yrs working same organisation and till date non of them received memo or show cause mail from hr or dept . Due internal office politics they forcing some employees to resigned. I want guidance what to do in such case. also note that bank contiously recruiting staff in other department but not moving staff from this dept. As all are well qualified banker left other organisation due to seeing good furtune in this bank.

A. If you are having a workers Union in your Bank and if they have any sort of settlement with the Bank you can take shelter under the terms of those settlements to prevent such termination. If the Bank is a member of IBA and is having a common settlement, so much the better. Finally, it is your Union which has to deal with this as individually your rights are only as much as the appointment letter and service rules provide..

Respected SIR / Madam This is prasanna I have completed Bsc Radiotherapy from Kidwai memorial Institute of oncology which under state govt. RECENTLY JOB Notifications came for 30 post of radiotherapy technologist.but they given eligibility as 2 year training radiotherapy required but in our entire karnataka there is no either diploma nor 2years training program on radiotherapy only Bsc degree is there since Bsc is degree need to pay degree scale they have called for 2 years program under c group job.. Is there possible to ask for b group. Or cancel the recruitment since no course available in karnataka.or once got selected is there any option for group salary. Other then karnataka state providing 2 year diploma

A. You have a good case for writ for direction to change the criteria as there is no such 2 year diploma.

Hi, I was a Manager in a Listed NBFC where i a dismissed. But there are some technical flaws that i found out during the dismissal process (during Appeal to the Appellate Authority of our company) which i bring to his notice but he continued with the earlier decision. Now my question is to which court i have file an appeal whether can i file writ petition directly in high court. Thanks in Advance

A. Yes, you can challenge the dismissal order through a writ petition. It would be advisable to approach vidhikarya lawyers.

A worker lodged a fake case on me for unpaid two month salary. Which period he mentioned in case . He was not working in my company. I dont have any proof to prove that i paid him what should i do

A. Feny that he was working for you at that time. Let him prove he did.

Dear Lawyers, I want to know that what kind of legal penalties we can charge to the employer. If suppose any employee is been terminated from the company without any valid/ strong reason behind it and the terminated employee is not ready to accept the termination then what kind of legal action we can take against the company and what penalties they have to pay to the employee. Employee can proof that he/she is been terminated without any proper reason. So when he/she can take action and on what grounds they will be penalized? Awaiting for your guidance.

A. A private employer can terminate your employment at his pleasure and the established principle of Law is that one cannot be forced to employ some one whom he doe not like, reason being irrelevant. However, if you are working in any company which is even partly a 'state' then your employment is protected.

Hi sir, My manager has told me that a written complaint is done against me that I am misbehaving the girl in office. So that why from tomorrow you can't come to office and taken the sin and key. I told them I have not done any such kind of things in office show me the complaint against me and who did it and what kind of misbehaving I have don. They not declared it to me. Near about a month gown no reply of my mail no mail of complain detail not a single written or mail document given by company why they told me not to come to office and even salary and termination also.

A. A lot depends upon who is your employer-manager. Is he a state owned company ? or a private employer? You dont stand a chance if you file defamation case.

I am working in company. my boss ordered to bring a 5KG gas cylinder from another division of our company. When I was bringing. It the cylinder fell down from bike and lost somewhere. I searched for it but I did not get it. When it told it to my employer he asked me to pay for the cylinder and demanded new cylinder. I have to pay for this now. I want to ask whether is it legal act as done by employer? Can he ask me to compensate?? Please. Help me.. cylinder cost 5000.

A. Dear Sir,
If you wish to continue your relations with your employer you can pay and continue your job peacefully otherwise you have to face hell in the hands your employer or to go out of service.
