Hello Experts, Can someone please confirm if after a Lok Adalat settlement happens in a 498a and DP 4 cases (compoundable in state of Telangana), can I approach the Honb'l HC to get it quashed

A. Hello Sir
Section 498-A IPC is non-compoundable. Non-compoundable offences are those where the court cannot record the compromise between the parties and drop charges against the accused.
Thus, your lok Adalat settlement is not valid and lok Adalat doesn't have any jurisdiction over a case of 498-A IPC. The High court would not quash the case of 498A on the basis of settlement decree of lok Adalat.

A. Hi,
Call recordings/ videos and other digital evidences are valid and legally accepted evidences in court. If the other party is trying to make illegitimate claims and such recordings can be helpful in disregarding the claims, then the court allows you to submit them. Renaming the recordings does not make it invalid and the evidentiary value would be same as that to prior of renaming it.

Husband not communicating properly

A. Matrimonial matter ko pyar se solved karna chahiye. Aap ke kathanusar ki kuch miss understanding ho gai hai hum dono ke bich. Usko apash me sitting karke solved karne ka paryash karna chahiye. Ho sakta hai koi solution nikal jae.
Agar nhi nikalta hai tab aap court me case file kar sakte hai.
Court case is last option hai.

A. Hi,
Both the son and the daughter are allowed to pay maintenance under the new law. It is up to the parents to determine whether or not they are prepared to accept the daughter's upkeep. The amount of maintenance will be determined by a mutually agreed upon rate between the two parties, as well as the family members' needs.

A. Hi,
In the case of a fake dowry case, the respondent has to reply to the charges. the innocence of the person will be brought forward and no innocence will be treated as guilty.

What is the RDO officer limits/ powers/ what kind of action can take using act 2007 senior citizen welfare.

A. Hi,
Under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 the RDO is vested with the responsibility of settling such petitions by presiding over the divisional maintenance tribunal (MT). The petitions are related to the quantum of maintenance for the senior citizens.

Yes, you can think about getting your marriage annulled or remarrying. Please think about all of your alternatives before moving further. If both parties are in a position to mutually terminate the marriage, you might contemplate divorce by mutual consent in this situation.

A. Dear Sir,
If such conversion is voluntary they cannot be any issue unless somebody lodge a complaint that such conversion is taking place under threat or misconception. Normally the married spouse cannot claim any Government benefits on the converted community category.

A. Dear Sir,
You have to collect such evidence atleast by appointing detective agency. The Courts never asks you to prove 100% of such relationship with her boyfriend. Every alternative husband claims that his wife is in adultery but it is very hard to place the material before the Court.

Is clicking a women photo to collect the evidence of misbehaviour with elder like father in law , who is doing wrong act like she comes and lies on the bed in front of father in law is wrong.

A. Dear Sir,
Normally, it is not an offence unless you wish to misuse such photographs for blackmailing her or otherwise. You may take the consent of your father-in-law and can lodge a complaint against such girl.
