A. Look for the JDA and the sanctioned building plan by the Local Authorities. If the plan does have it then its fine. If the plan does not have it then you must object it and should bot allow this happen. This will be an illegal construction inviting the wrath of the authorities and other issues.

It all depends on the name in the will. If the will is done in the name of someone else then it would be difficult to acquire the property. Kindly study the will properly and you would be able to understand. However, your mother or any one else can voluntarily transfer some of the property in your name or gift it.

The mutation cost in West Bengal for an agriculture land situated in rural area is Rs.40 Per Decimal, for a land in municipal area other than KMDA is Rs.60 and for a land situated in municipal area within KMDA is Rs. 80 per Decimal. A. Even if you do so how is it going to affect them as the sub-registrar does not evaluate whether there is a case pending or not during the registration of a property or land but it is the duty of the other legal heirs or parties to raise objection in front of him.
So,there will be some responsibility on you (your mother) to come forward and stop the process of transfer to tow brothers which you have to do openly by filing case and silently.

Since the land is of your grandfather, your aunts will have a rightful share in the property however, the amount will depend on the type of property and the religion that you follow because there are separate civil laws for different religious groups.
